• Intellectual Property Rights: All intellectual property rights and associated rights, such as copyrights, trademarks, patents, model rights, trade name rights, database rights, and more.
• Platform: The online platform accessible via www.LeakedExams.com and its subpages, which allows users to access and upload study materials, whether for free or against payment.
• Profile: An individual or group section created and maintained by users when registering on the Platform.
• Study Material: All information uploaded by users on the Platform, whether free or paid.
• LeakedExams: Refers to the company LeakedExams LTD (if applicable to your location).

Article 2: Applicability

• These Terms and Conditions apply to all users of the LeakedExams platform.
• LeakedExams reserves the right to modify or supplement these Terms and Conditions. The latest version will be available on the Platform, and your continued use of the Platform implies your acceptance of any changes.

Article 3: Profile

• To use the Platform effectively, you must create a Profile following the Platform's instructions.
• You must provide accurate and complete information when creating your Profile.
• If you are under 18 years old, you must obtain consent from your legal representative (guardian or parent) before creating a Profile.
• You are responsible for keeping your username and password confidential.
• LeakedExams may modify, alter, or shut down the Platform, and you may delete your Profile if you disagree with these changes.

Article 4: Functionalities of the Platform

• LeakedExams provides a platform for users to exchange study materials, and LeakedExams is not responsible for the content of these materials.
• The Platform is provided on an "as is" basis without guarantees, warranties, or undertakings unless explicitly stated.
• LeakedExams cannot be held liable for any damages resulting from the use of the Platform.

Article 5: Uploading Study Materials

• Users can upload study materials to the Platform, which may be downloaded by other users.
• You decide the price for your study materials, and LeakedExams reserves the right to insert third-party advertisements.
• You retain your Intellectual Property Rights in the study materials you upload.
• By uploading study materials, you grant LeakedExams a license to use certain personal data and the materials for platform-related purposes.

Article 6: Downloading Study Material

• Users can download study materials, free or paid, with a Profile.
• You may rate the study materials you download.
• Payment for study materials is subject to specified methods and conditions listed on the Platform.
• LeakedExams may refund purchases under certain conditions.

Article 7: Payment

• Users can offer study materials for payment, and the price is determined by the uploader.
• LeakedExams acts as an intermediary for payments, and these Terms and Conditions apply only to Platform usage.
• Payments are handled by a third party, and service costs may apply.
• Users are responsible for tax declarations if applicable.

Article 8: Notice and Take Down

• Users can report infringing study materials through a notice procedure.
• Notices should include specific information, and LeakedExams may forward notices to the responsible party.
• LeakedExams reserves the right to take action upon receiving a valid notice.
• Users indemnify LeakedExams against claims arising from notices.

Article 9: Availability of the Platform

• LeakedExams may temporarily suspend or reduce Platform access without notice.
• LeakedExams can make procedural and technical changes without prior notification.
• LeakedExams does not guarantee uninterrupted Platform access.

Article 10: Intellectual Property Rights

• Intellectual Property Rights for the Platform and its Content (excluding study materials) belong to LeakedExams.
• Users are granted a limited, personal right to use the Platform and Content.
• Users must not alter or remove trademarks or recognition signs.

Article 11: Liability

• LeakedExams's liability for damages is limited to insurance coverage or specified amounts.
• LeakedExams is not liable for special, incidental, or consequential damages.
• Liability limitations do not apply in cases of willful intent or gross negligence.

Article 12: Force Majeure

• In cases of Force Majeure (unforeseen circumstances), LeakedExams is not liable.
• Force Majeure includes various unexpected events that can disrupt Platform services.

Article 13: Termination

• Users can terminate their agreement by discontinuing Platform use and deleting their Profile.
• LeakedExams may restrict or suspend user activities or delete Profiles for violations.
• Payments owed to users will be transferred even after Profile deletion.

Article 14: Applicable law and competent court

• These Terms and Conditions are governed by the laws.
• Disputes will be settled exclusively by a competent civil court unless otherwise mandated by law.

Article 15: Miscellaneous

• If any provision is found to be illegal or unenforceable, it will be limited to the minimum extent necessary.
• LeakedExams may assign rights and obligations to third parties, with notification to users.
